MEKANISME EKSEKUSI BARANG JAMINAN PADA AKAD MUSYARAKAH DI BMT UGT SIDOGIRI BANGKALAN

Abstract

Theoretically, there is no guarantee in musyarakah financing, but to avoid the occurrence of irregularities it is permissible to ask for this guarantee as contained in the DSN fatwa No. 08 / DSNMUI / IV / 2000 concerning Musharaka Financing. The application of collateral to a financing is normal and can be said to be very important. However, considering that BMT is a sharia-based institution, BMT should follow Islamic law without exception. The guarantees required by BMT include: gold, motorized vehicle BPKB, land certificate, etc. In this paper, the study focuses on the mechanism of execution of guarantees on the musyarakah contract at BMT UGT Sidogiri Bangkalan in the Shariah Business Law perspective.          

The type of research used in this study is a qualitative type with a descriptive approach with data collection techniques through unstructured interviews, observations and documentation, than analysed using content analysis teqniques. From the results of the study, it was found that the musyarakah financing procedure at BMT UGT Sidogori
